Introduction

AgentAya Limited ("AgentAya," "we," "us," "our") operates the AgentAya Consulting service available at consult.agentaya.com (the "Service"). This Privacy Policy explains what personal information we collect, how we use it, who we share it with, and the choices you have.

AgentAya is the data controller for the personal information you provide through the Service.

Information we collect

We collect information in three ways: information you provide directly, information collected automatically when you use the Service, and information from third-party services.

Information you provide directly

When you book a free 20-minute discovery call, we ask for:

  • Your full name
  • Email address
  • Job title
  • Company name and (optionally) company website
  • Approximate team size
  • A brief description of what you're hoping to discuss

When you complete our optional pre-call questionnaire, we ask for additional context about your business, including industry, approximate revenue range, technical setup, and your goals for the call. All questions in this questionnaire are optional.

Information collected automatically

When you visit the Service, we automatically collect:

  • Technical information such as your IP address, browser type, device type, and operating system
  • Information about how you use the Service, including pages viewed, time spent, links clicked, and form interactions
  • Referral source (the website you came from, if applicable)
  • Marketing campaign parameters (UTM tags) if you arrived from a marketing campaign

We collect this information using cookies and similar tracking technologies. You can manage your cookie preferences via the consent banner that appears on your first visit, or by clicking "Cookie preferences" in the footer.

Information from third-party services

When you book a call, the booking is managed through Calendly. Calendly collects your name, email, and chosen meeting time, and shares this information with us. Calendly's own privacy policy applies to information you provide to them: https://calendly.com/legal/privacy-notice.

How we use your information

We use your information to:

  • Schedule and conduct your discovery call
  • Prepare for our conversation by reviewing the context you've shared
  • Send you booking confirmations, reminders, and follow-up communications related to our call
  • Improve the Service and understand how visitors use it
  • Measure the effectiveness of our marketing campaigns
  • Comply with legal obligations

We do not sell your personal information to third parties.

Legal basis for processing (UK and EU residents)

Under UK GDPR and EU GDPR, we rely on the following legal bases:

  • Performance of a contract or pre-contract steps: Processing your booking request and conducting the discovery call.
  • Legitimate interests: Operating and improving the Service, understanding visitor behaviour through analytics, and securing the Service against fraud and abuse. Our legitimate interests are balanced against your rights and freedoms.
  • Consent: For marketing-related cookies (e.g., Meta Pixel, LinkedIn Insight Tag) and any future marketing communications. You can withdraw consent at any time.
  • Legal obligation: Where we need to retain information to comply with applicable law.

Who we share your information with

We share your information only with:

  • Service providers who help us operate the Service, including:
    • Google (Workspace for email, Google Sheets for storing form submissions, Google Analytics, Google Tag Manager)
    • Calendly (booking management)
    • Meta and LinkedIn (advertising platforms, only with marketing consent)
    • Our hosting providers
  • Our team and contracted consultants who deliver the discovery call and any subsequent engagement
  • Legal and professional advisers where required to protect our legal rights or comply with law
  • Authorities or regulators where required by law

We require all service providers to handle your information securely and only use it for the purposes we specify.

International transfers

Some of our service providers are based outside the UK and EU (notably in the United States). When we transfer your information internationally, we rely on appropriate safeguards such as the UK International Data Transfer Agreement, EU Standard Contractual Clauses, or adequacy decisions where available.

How long we keep your information

  • Form submissions and questionnaire responses: Retained for 24 months, or longer if you become an active client and the information remains relevant to our ongoing relationship.
  • Booking records: Retained for the duration of our engagement and for 6 years afterwards for accounting and tax purposes.
  • Analytics data: Retained in line with our Google Analytics configuration (currently 14 months).
  • Marketing data: Retained until you withdraw consent or for 24 months of inactivity, whichever is sooner.

Your rights

If you are in the UK or EU, you have the following rights:

  • Access: You can ask for a copy of the personal information we hold about you.
  • Correction: You can ask us to correct inaccurate information.
  • Deletion: You can ask us to delete your information, subject to certain exceptions.
  • Restriction: You can ask us to limit how we use your information.
  • Portability: You can ask for a copy of your information in a portable format.
  • Objection: You can object to our use of your information based on legitimate interests, including for marketing purposes.
  • Withdraw consent: You can withdraw consent for any consent-based processing at any time.
  • Complain: You can lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk.

Cookies

The Service uses cookies and similar technologies. The categories are:

  • Strictly necessary: Required for the Service to function. Cannot be disabled.
  • Analytics: Help us understand how visitors use the Service (Google Analytics).
  • Marketing: Used to measure advertising performance and show relevant ads (Meta Pixel, LinkedIn Insight Tag). These only load if you grant marketing consent.

Security

We take reasonable technical and organisational measures to protect your information, including encryption in transit, restricted access controls, and regular security review. No system is completely secure, however, and we cannot guarantee absolute security.

Children

The Service is intended for business users. We do not knowingly collect information from anyone under 18. If you believe we have inadvertently collected information from a minor, please contact us and we will delete it.

Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version with a new "Last updated" date. For material changes, we will make reasonable efforts to notify you, for example by email or via a notice on the Service.
